(hereinafter referred to as the “Controller”), in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “GDPR”), the Polish Act on the Protection of Personal Data of 10 May 2018, and other applicable legal provisions, including the Act on the Provision of Electronic Services and the Telecommunications Law. This Policy also aligns with the UK General Data Protection Regulation (“UK GDPR”) for users located in the United Kingdom.

3. Purposes and Legal Basis of Data Processing

The Controller processes personal data for the following purposes:
  • to provide services by electronic means (Article 6(1)(b) GDPR);
  • to conduct statistical analysis and measure website traffic using tools such as Google Analytics (Article 6(1)(f) GDPR);
  • to carry out marketing activities, including profiling and remarketing via cookies, Meta Pixel, Google Ads, and YouTube (Article 6(1)(a) and (f) GDPR);
  • to respond to inquiries and establish contact through contact forms (Article 6(1)(f) GDPR);
  • to maintain and manage social media profiles on Facebook, Instagram, YouTube, and TikTok (Article 6(1)(f) GDPR).

4. Data Recipients

  • hosting service providers and providers of IT systems and software solutions;
  • partners cooperating with Impix on the basis of data processing agreements, as required by applicable law.

5. Transfers of Data Outside the EEA

Personal data may be transferred to third countries (e.g., the United States) due to the use of services provided by entities such as Google, Meta, and TikTok. Such transfers are conducted in accordance with Chapter V of the GDPR, and where applicable, based on Standard Contractual Clauses approved by the European Commission or the Information Commissioner’s Office (ICO) for the UK.

6. Data Retention Period

Data shall be retained for the following periods:
  • for the duration of the contract or service delivery;
  • until the withdrawal of consent, where data is processed on the basis of consent;
  • for the duration necessary to pursue the legitimate interests of the Controller;
  • for periods specified under applicable legal obligations (e.g., tax and accounting regulations).

7. Rights of Data Subjects

Data subjects are entitled to the following rights under the GDPR and UK GDPR:
  • the right to access their data and obtain a copy thereof;
  • the right to rectify inaccurate or incomplete data;
  • the right to erase data (“right to be forgotten”);
  • the right to restrict the processing of their data;
  • the right to data portability;
  • the right to object to the processing of data on grounds relating to their particular situation;
  • the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal;
  • the right to lodge a complaint with the competent supervisory authority (e.g., the President of the Personal Data Protection Office in Poland or the Information Commissioner’s Office in the UK).
